In an email exchange dated February 24th, 2014 between Gavin Andresen and Pavol Rusnak, the former commented that 40 bytes is small enough to never require an OP_PUSHDATA1. Pavol Rusnak added that 75 bytes also meet this requirement. The conversation seems to be related to a discussion on the technical details of Bitcoin transaction data.
